Terms & Conditions

These terms of use the (hereinafter “Terms” or “Agreement”) contain the terms and conditions pursuant to which you may access and use the website owned and operated by Royal Hair (the “Site”). Each time you access this Site you are acknowledging and agreeing to be bound by the Terms. These Terms may be updated from time to time and it is your obligation to review the Site each time you visit to ensure you are aware of the most current Terms. Royal Hair, and its Affiliates and Suppliers (as defined below) are referred to in this Agreement as “we,” “us,” and “our.” You, the Person visiting and utilizing this Site, are referred to as “you”, or “your”.

PROVIDERS OF PRODUCTS. The products and product features (“Product” or “Products”) available via this Site are provided by Royal Hair (“royalhair.com”, “us” or “we”). We may also partner with other companies (“Suppliers”) or affiliates to provide or sell you a Product.
ACCESS TO SITE, USE AND GOVERNING LAW. Access to, and use of, this Site is subject to all laws and regulations applicable in the Province of Ontario. This Agreement is made and will be interpreted under Ontario law, and you submit to the exclusive jurisdiction of Ontario courts located in Toronto. Notwithstanding Ontario laws and regulations, individuals residing in or accessing the Site in an area where the access to or use of the Site or any part of is illegal or prohibited are not permitted to use the Site. It is your responsibility to determine if you can legally use the Site in compliance with all applicable laws. Please be aware that certain Products and/or Product features may not be offered, applicable or available to you based on residency or other eligibility criteria or factors. Persons accessing this Site are required to obtain information about and observe any relevant restrictions.

If any term or condition in these Terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed to be severable from the rest of the Terms and shall not affect the validity and enforceability of any remaining provisions of the Terms. There are terms, exclusions and conditions of the written contracts relating to Products mentioned on this Site are not fully described on the Site or in this Agreement. Their interpretation is governed by the terms and conditions of the written contract you enter with us, and by any applicable laws and regulations.

FEES AND CHARGES; PAYMENT SOURCE. By placing your Product order, you authorize us to charge your credit card or other account that you have designated for such purpose (“Payment Source”). You agree to pay for the Products, in Canadian dollars, using the Payment Source provided at the time your order is placed. In the event that you have previous purchased a Product from us, your Payment Source may already be on file with us. While you are responsible for updating your Payment Source if it is no longer valid, you further authorize us to attempt to automatically update your Payment Source if the information we have on file is no longer valid. If we are successful in obtaining updated credit or debit card information, we will update your records accordingly and charge any updated Payment Source using the updated information. In the event that we are unable to charge and/or update your Payment Source, we may cancel your order. We are not responsible for any overdraft/over-the-limit charges or bank fees triggered by your order being processed.
PRODUCT CANCELLATION AND REFUND POLICY. ALL SALES OF ROYAL HAIR PRODUCTS ARE FINAL. THERE ARE NO REFUNDS. Once the transaction has been processed you are no longer able to cancel the purchase of your Royal Hair Product. You will not be entitled to a refund for any Royal Hair Product.
NO WARRANTY OR GUARANTEE OF PRODUCT. WHILE ROYAL HAIR STRIVES TO CREATE THE BEST PRODUCTS POSSIBLE, ROYAL HAIR DOES NOT WARRANTY OR GUARANTEE THE QUALITY, USEFULNESS OR THE DURATION OF ITS USABILITY OF ANY PRODUCT.

DISCLAIMER – FIT OR USE OF PRODUCT ROYAL HAIR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. ROYAL HAIR CANNOT GUARANTEE AND DOES NOT PROMISE ANY SPECIFIC RESULTS FROM USE OF ITS PRODUCTS OR THIS SITE.

PRODUCT COMPONENTS. Royal Hair uses natural human hair in some of their Products. The use of natural human hair may cause some risks due to use and care of the hair by the original owner/grower of said hair. Royal Hair makes no warranty, guarantee or representation regarding the quality, condition or previous use of the hair.

CHANGES TO PRODUCTS, PRICING, AND TERMS; TERMINATION. We may change the prices for our Products at any time, without notice, prior to purchase.

PRODUCT AVAILABILITY. In the event that certain Products and/or Product features may not be offered, you will be notified. In such cases, you may be advised of one or more alternative Products, to the extent that other Products are available. In the event that you are advised of the availability of alternative Products, you should carefully evaluate any such Product to determine its suitability.
ACTIVATION/PROMOTIONAL CODES. If you are using a promotional code (“Code”) you will be required to provide your Code during the course of your enrollment process in order to complete your order for the Product that corresponds to your Code. Your Code may have an expiration date beyond which your Code will no longer be valid. If your Code is entered incorrectly, has expired, is invalid or otherwise not accepted, and/or you are a charged a fee, the fee(s) charged will not be refunded.
NO GUARANTEE OF PRODUCT AVAILABILITY. Because of the nature of internet and online communications, this Site or the Products may not perform as intended despite our efforts, those of your internet service provider, and yourself. We do not guarantee uninterrupted or error free operation of this Site. We will use reasonable efforts to maintain operation of the Site and availability of the Products at all times.
OWNERSHIP. The information, materials, text, graphics, images, logos, site design, and the selection, assembly, and arrangement of the Site (collectively “Content”) is proprietary in nature and protected by applicable Canadian copyright and trade-mark laws, as well as by the copyright and trade-mark laws of other countries. The Content cannot be altered without infringing on our rights, including without limitation our moral rights. As such, you may not remove, alter or cover any copyright or other proprietary notices placed on this site or on products or related Content acquired through this Site. We, collectively or individually, retain ownership of all intellectual property rights in this Site, including without limitation the Content. For the avoidance of doubt, the Content may not be copied, distributed, displayed, modified, reproduced, performed, published or reverse engineered in whole or in part without our prior written permission.
PERSONAL INFORMATION; AUTHORIZATION. In order to provide Products to you, you must provide us with certain personal information about yourself. You consent, authorize and instruct us to collect, use, monitor, compile and disclose your personally identifiable information. By placing your order, you acknowledge receipt of our Privacy Policy and agree that we may use and share your personal information in accordance with our Privacy Policy, which is incorporated by reference into this Agreement.
DATA COLLECTION AND DISCLAIMER. Royal Hair will use its best efforts to safeguard and protect any data collected from you. However, Royal Hair cannot guarantee the safety or security of any data collected from you. Royal Hair will not be responsible for any breach of our system or leak of your data.

SECURITY, COOKIES AND LINKS. Once you have gained access to the Site, it is highly recommended that you do not leave the computer terminal until you have left the Site. We do not warrant that any information, software or other material accessible through the Site or through links to other web sites are free of viruses, worms, Trojan horses or other harmful components. Without the use of encryption, communication through the internet or electronic communication is not secure and privacy cannot be ensured.

The Site uses cookies. A cookie is a small file containing an identity code. With your consent, your computer accepts the cookie and stores it. When you next visit the Site, the code is retrieved, allowing an individual visitor or computer to be recognized. We may use cookies in order to facilitate your future visits on the Site. Subject to the conditions described on the privacy page of this Web Site, we shall have no obligation of any kind with respect to such Feedback and shall be free to use and distribute the Feedback to others without limitation, including, but not limited to developing and marketing products incorporating such Feedback.

ACCURACY OF DATA. Royal Hair does not warrant the accuracy of any data in its system, or the accuracy of any Product or report. All information about individuals or any Product or report is/was provided by individuals, or users. Royal Hair does not review, check or verify the accuracy of any information provided by its customers.

MISCELLANEOUS. It is understood and agreed that all paragraph headings have been inserted herein for convenience of reference only and do not form part of this Agreement.

This Agreement shall enure to the benefit of and be binding upon the parties and their respective heirs, executors, administrators, successors and assigns, as the case may be.

All words importing the masculine gender only shall include the feminine gender and the neuter (as appropriate) and vice versa. All words importing the singular shall include the plural and vice versa.
